Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Proof of Budget app and this website (together, the "Service"), provided by Nordic Tug LLC, referred to here as "we", "us", or "our". By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Proof of Budget is a native personal finance app for iOS, iPadOS, and macOS. It provides budgeting, transaction tracking, subscription and recurring-bill tracking, goals and debt tracking, and Bitcoin on-chain tracking. Optionally, you can link financial institutions through Plaid to sync transactions.

The Service is an informational tool. It is not a bank, broker, money transmitter, tax preparer, or investment adviser, and nothing it displays is financial, investment, tax, or legal advice. We do not hold, move, or custody your funds or your Bitcoin.

3. Eligibility

You must be of legal age to form a binding contract in your jurisdiction to use the Service. By using it, you represent that you meet this requirement and that you are not barred from using it under applicable law.

4. Accounts and Sign in with Apple

The Service uses Sign in with Apple for authentication. You are responsible for maintaining the security of the Apple account you use and for all activity that occurs under your Proof of Budget account. Notify us promptly at proofofbudget@nordictug.me if you believe your account has been compromised.

5. Third-party services

We are not responsible for third-party services, and their failure or unavailability may interrupt parts of the Service.

6. Subscriptions and payments

Some features may require a paid subscription. Subscriptions are sold and processed through the Apple App Store. Payment is charged to your Apple account at confirmation of purchase.

If your subscription lapses, paid features may become unavailable. Prices and plans may change on a going-forward basis.

The Service, including its software, design, and content, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service on devices you own or control, for your own non-commercial use. All rights not expressly granted are reserved.

Your financial data is yours. We claim no ownership of the budgets, transactions, or records you create or import.

9. Privacy

Our handling of your information is described in our Privacy Policy, which forms part of these Terms. In short: financial records live on your device and sync via your own Apple CloudKit account, and our servers store only a pseudonymous Apple identifier, Plaid item IDs, institution labels, encrypted access tokens, webhook metadata, and subscription-tier metadata — never transactions, balances, account details, or holdings.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data obtained through it — including data from your financial institution via Plaid, or on-chain Bitcoin data — will be accurate, complete, or current. You are responsible for verifying your own financial information and for your own financial decisions.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two paragraphs above may not apply to you.

12. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; material changes will be reflected in the effective date above and, where appropriate, communicated in the app. Continued use after an update means you accept the revised Terms.

13. Termination

You may stop using the Service at any time by unlinking your accounts and deleting the app. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use creates risk or legal exposure. On termination, the license in Section 8 ends; Sections 8, 10, 11, and 14 survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, USA, and disputes will be resolved in the courts of the state and federal courts located in Oregon.
